On behalf of the Secretary of State, Home Office (Immigration Enforcement) makes representations in support of the following application for the review of a premises licence, relating to the prevention of crime and disorder objective, including the prevention of illegal working and immigration crime in licensed premises.

Representations are being made for the following reasons:

Immigration Enforcement Alcohol Licensing team are making this representation in support of our colleagues from the South East ICE Team (Immigration Compliance & Enforcement).

 

We confirm that Officers from the South East ICE Team conducted a visit to Donatello’s Italian Restaurant 1-3, Brighton Place, Brighton, BN1 1HJ on 09 November 2022 following intelligence received alleging that the business was employing large numbers of illegal workers from Uzbekistan.

 

Upon arrival at the premises officers encountered six persons who were identified as working illegally at the restaurant.

Re Donatello's Immigration Review – 1445/3/2022/03977/LAPREV

 

Sussex Police confirm receipt of the notification that a review of the premises licence under the 2003 Licensing Act has been submitted by South East Immigration.

Whilst we are not aware of any breaches of the premises licence conditions or that the venue has had a need for police attendance in regards to incidents, under the licensing objective of the Prevention of Crime and Disorder, Sussex Police supports this review . The seriousness of the actions taken by the management to employ illegal workers is in no way promoting the licensing objectives. It raises concerns over how the venue is generally being run regarding their employees. Areas such as modern slavery, staff training and welfare and possible misreporting to Revenue & Customs are all areas of concerns and that need to be taken into consideration when reviewing this request to revoke the licence.

Due to the Designated Premises Supervisor Leonardo Addis being listed as a director of the Premises Licence Holder Pietro Addis & Sons Ltd we support the request from South East Immigration seeking for the premises licence to be revoked.

Dear Redacted,

I completely understand the enormity of the licence review at Donatello, as do the licence holders.

I write this as a local, independent business owner and family friend.

 

I 100% do not believe a deliberate criminal act was intended and was a stupid admin oversight.

When I was aware of the detail I quickly checked my paperwork of an existing staff member as an error so easily made. They have a NI number and pay taxes… I have everything needed.

I know as a family business Donatello have always looked after their staff. Paying above minimum wage, hosting Christmas Day for those with no family here. 

They are also a huge supporter of local charities. Hosting events, gifting prizes to charities.

To lose their licence and/or be closed would have a huge impact on the local community. Not just the staff they directly employ but the extended work done by local food suppliers, printers, decorators, servicing engineers, IT support…

Most of all, I know they are devastated that after the tragic death of their mother, Sue Addis, that they have messed up. 

Sue Addis mentored me in my early days of business and we continued to talk shop weekly as well as becoming good friends.

Her sons are doing an incredible job stepping into her shoes. Learning as they go. This will be a big learn.

 

I hope the above is considered when making a decision on their licence.

That there was never any intention to commit 'a crime and disorder offence' - having no MD due to dreadful circumstances and ensuing court cases compounded by losses of staff in lockdown, oversights appear to have occurred.  To confirm - all the foreigners involved were on payroll, paying tax and with a national insurance number.

Representation to the review for Donatello’s Restaurant Brighton

 

I recently went to Donatello’s restaurant with my family and saw your letter

posted at the door.

 

I would like to express my huge gratitude to the restaurant and tell you how

much joy it has brought to me and my family over the years.

 

Whenever we go there, we are always treated warmly. The staff are courteous,

kind, accommodating and efficient. Not only that, but the dining experience is

unprecedented. The food is homemade, nutritious and is made with great care.

 

And the exceptional prices ensure that no one is excluded from enjoying a meal

there.

 

The whole team at Donatello’s (and you can tell they work superbly as a team)

make us feel welcome.

When it is busy - which is nearly always the case because of the great service and

food - the team entertain us in the long queue and bring the customers together

with fun and laughter. I usually book in advance these days, but I continue to see

the team interacting with the customers at the door by singing, telling jokes and

taking selfies.

The Donatello family have had some difficult times over the past year, but this

has not stopped them from supporting us, the customers, and local charitable

concerns in and around Brighton. Their warmth and generosity to the local

community is exceptional and it is incredible how they have kept this selfless

attitude throughout times of great sadness.

Donatello’s is part of the Brighton and extended community and closing it would

be a tremendous loss for the people of Brighton and beyond.

 

I have watched the staff interact with the elderly, with the disabled, with

children, with people celebrating, and with everyday people like you and me, and

their compassion and warmth is unrivalled.

I’m sure you understand the great value of this restaurant, this community of

people who bring happiness to hundreds of customers every day. Perhaps you

have also eaten there or watched as they have taken care of your own aging

mother’s or disabled friend’s needs with patience and kindness.

 

Over the years Donatello’s restaurant has brought so much to the local, national

and international community. Nestled between the Lanes and the seafront,

Donatello’s restaurant is like an ambassador for Brighton that has given so so

much, and that has the potential to keep giving, to tens of thousands, even

millions, of people in the future. It has become an essential part of Brighton’s

foundation. A place with this much heart and significance cannot be taken away.

They were, and still are passionate in their support of the safety of the community in The Lanes. To my knowledge they were the first major sponsor of community officers to patrol The Lanes making it a safer place for everyone to enjoy and always fully cooperated with the police.

I have been visiting the restaurant with my family for many years now and would be devastated if they were to lose their licence. We have many happy memories from the past and had hoped to make many more in the future.

 

They are very much a part of the fabric of the local area, both economically, and socially. Offering high quality food at affordable prices, Donatello enables families and friends to get together, which is particularly valuable after the recent pandemic and now with the cost of living crisis. We urge that you retain their licence and allow this to continue, for the sake of the local population and tourists like us who visit Brighton regularly.

Thank you for your recent email confirming receipt of my submission and the requirement to respond to one of the key criteria upon which this case will be decided.

 

The removal of the licence from Donatello will not impact negatively upon the Prevention of Crime and Disorder in the city centre.  The premises are extremely well run and have traded for many years with a full licence without any crime and disorder issues.  Donatello has a valued reputation as a safe, family restaurant where people of all ages can enjoy themselves without fear of crime or disorder and I trust this will be consider by the licensing panel.
